THE IMMIGRATION TO DENMARK
The Immigration to Denmark and an introduction to these ways
What are the ways of immigration to Denmark?
There are six ways to obtain Denmark residence permit and citizenship. Marriage, birth, asylum, work, education and investment. In this article we discuss all the six ways of immigration to Denmark. Denmark or officially kingdom of Denmark is a sovereign state in northern Europe. The southernmost of the Scandinavian nations, Denmark lies southwest of Sweden and south of Norway and is bordered to the south by Germany. Denmark is one of the best countries in the world with high level of education and good quality of life. In 2019 Denmark has been named the best country for women to live in. Denmark’s official language is Danish which is one of the most difficult languages in the world but most of the Danish people are fluent in English.
Danish immigration and dual citizenship in Denmark and the conditions of loss of citizenship
Following on the path to immigration to Denmark, it should be noted that the law of the nationality of Denmark was based on the Constitution of the country in 1953 and the Danish National Stabilization Act in 2003 and 2004. Danish nationality can be obtained in one of the following ways.
Automatically at birth if born in the Kingdom of Denmark (Denmark, Faroe Islands, Greenland) and at least one of the parents has Danish citizenship.
Automatically at birth if born outside the Kingdom of Denmark and at least one of the parents has Danish citizenship.
Automatically if a person is adopted as a child under 12 years of age
By declaration for nationals of another Nordic country
By naturalization, that is, by statute
Automatically at birth if either parent is a Danish citizen, regardless of birthplace, if the child was born on or after July 1, 2014
Conditions for losing Danish citizenship:
- Automatically if a person acquired Danish nationality by birth, but was not born in the Kingdom of Denmark and has never lived in the Kingdom of Denmark by the age of 22 years (unless this would render the person Stateless or the person has lived in another Nordic country for an aggregate period of no less than 7 years)
- By court order if a person acquired his or her Danish nationality by fraudulent conduct, in this case for example a sham marriage
- By court order if a person is convicted of violation of one or more provisions of Parts 12 and 13 of the Danish Criminal Code (crimes against national security), unless this would render the person stateless
- By voluntary application to the Minister for Refugee, Immigration and Integration Affairs (a person who is or who desires to become a national of a foreign country may be released from his or her Danish nationality by such an application)
Danish citizenship through admission
One must have permanent residence status in the Kingdom of Denmark in order to become a citizen.
9 years of continuous residence, with restricted allowance for interrupted residence of up to 1 year or 2 years in special circumstances (education, family illness). Continuous residence is not clearly defined, but one must state periods of absence from the Kingdom of Denmark longer than 14 days.
8 years of continuous residence for people who are stateless or with refugee status
Each year of marriage to a Danish citizen reduces the requirement by one year, to a maximum reduction of 3 years. For example, as little as 6 years of continuous uninterrupted residence for people who have been married to Danish nationals for 3 years. One year of cohabitation before marriage counts as a year of marriage for this purpose.
There is a special and little mentioned clause which allows for absences from the Kingdom of Denmark of longer than 1 or 2 years if one is married to a Danish citizen. The total period of continuous residence should be at least 3 years and it must exceed the total periods of absence, AND either: the period of marriage being at least 2 years or the total period of residence in the Kingdom of Denmark being 10 years less the period of marriage and 1 year for cohabitation before marriage). One must still have permanent residence.
If one is married to a Dane working ‘for Danish interests’ in a foreign country, then this period of absence from the Kingdom of Denmark can be regarded as residence in the Kingdom of Denmark.
Dual citizenship in Denmark
In October 2011, the new government declared its consent to dual citizenship. In December 2014, the Danish Parliament passed a law authorizing citizens of Denmark to acquire second citizenship, and also allowed foreigners to choose their second citizenship in Danish. There was also a new regulation allowing those who had previously lost their Danish citizenship by obtaining another nationality to acquire Danish citizenship. This law remains until 2020.
Immigration to Denmark through birth
Before the immigration to Denmark through birth, it is necessary to explain the system of soil and blood before birth.
Based on the principle of the soil, any person born on the territory or territory of one country also receives the citizenship of that country, and the blood principle is another form of granting of nationality according to which the nationality of each person is based on the nationality of one or both of the parents. According to Danish law, Danish citizenship and residence are granted to the following persons by birth.
- A child born of Danish parents on or outside the Danish soil.
- A child born of a father with Danish citizenship or foreign motherhood in or outside Danish territory. It should be noted that if the father of a Danish citizen and a foreign mother are not formally married, the child born can choose Danish citizenship.
- A child born of a Danish citizen with Danish nationality and a foreign father on or outside the Danish soil. It should be noted that this person must apply for citizenship.
- A child born of a Danish father or mother has been living in Danish for eight years in Denmark.
- Under the Citizenship and Residence Act in Denmark, persons born of a different parenting parent can be of the 2nd nationality by the age of 22, and then apply for a nationality.
- A child born of an unknown parent or an unmarried parent in the territory of Denmark.

Asylum seeker: In accordance with the Geneva Convention, which was adopted by the UN special session on 1951 (July 28th) and was implemented on April 19, 1954, asylum seekers have been forced to flee for fear of persecution, war and violence. From their own country. In fact, someone who is harassed in his own country for various reasons such as race, nationality, political or religious beliefs, or membership of a particular social group is therefore if return to his country he will be punished.
Refugee: An asylum seeker whose application for asylum has been accepted in a country.
Therefore, in these recent years many people seek for asylum with false cases and they rather lie just to get residency in other countries. And for that reason, most of the countries make asylum harder each year. It is wrong to lie for getting residence permit in a country. Many people change their religion or create false documents just to get residency in a country. Denmark is not accepting any asylum seeker right now and in this case we offer everyone to find other ways for immigration.
